Terms of Service

1. Service Description

Scan365.ai is an AI-powered cybersecurity risk scanning platform that provides automated security assessments for websites, Microsoft 365 environments, email security configurations and infrastructure. The service produces risk scores, findings reports and recommendations based on publicly available information and configuration checks.

Important limitation: Scan365.ai performs non-intrusive, passive security checks only. It does not perform penetration testing, exploit vulnerabilities or attempt to gain unauthorised access to any system. Results are indicative and should not be used as the sole basis for security decisions. Engage a qualified cybersecurity professional for comprehensive security assessments.

2. Acceptable Use

You may only use Scan365.ai to scan domains and systems that you own or have explicit written authorisation to scan. Unauthorised scanning of third-party systems is prohibited and may violate Australian and international computer crime laws including the Criminal Code Act 1995 (Cth).

You must not use Scan365.ai to:

• Scan domains or systems without authorisation from the owner
• Conduct any form of attack, intrusion or denial of service
• Attempt to reverse engineer, decompile or extract source code
• Resell or redistribute scan results without prior written consent
• Use the service for any unlawful purpose under Australian law
• Create multiple free accounts to circumvent scan limits

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify IT Service Link immediately at admin@itsl.com.au if you suspect unauthorised access to your account.

IT Service Link reserves the right to suspend or terminate accounts that violate these Terms or that are associated with fraudulent, abusive or illegal activity.

4. Subscriptions and Payments

Pro and Enterprise subscriptions are billed in advance on a monthly, quarterly or annual basis in Australian Dollars (AUD) inclusive of GST where applicable. All payments are processed by Stripe, our authorised payment processor.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel at any time and your access will continue until the end of the current paid period.

IT Service Link reserves the right to change pricing with 30 days written notice to your registered email address.

5. Refund Policy

We offer a 14-day money-back guarantee on all new Pro plan subscriptions. Refund requests must be submitted within 14 days of the initial payment to admin@itsl.com.au. See our Refund Policy for full details.

6. Intellectual Property

All content, software, trademarks, logos and intellectual property on Scan365.ai are owned by IT Service Link or its licensors. You may not reproduce, distribute or create derivative works without express written permission.

Your scan data and reports remain your property. By using the service you grant IT Service Link a limited licence to process and store your data to deliver the service.

7. Limitation of Liability

To the maximum extent permitted by Australian law, IT Service Link's total liability for any claim arising from use of Scan365.ai is limited to the amount you paid in the 12 months preceding the claim.

IT Service Link is not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business, arising from your use of or inability to use Scan365.ai.

Scan365.ai scan results are provided for informational purposes. IT Service Link makes no warranty that the service will identify all security vulnerabilities or that following recommendations will prevent a security incident.

8. Privacy

Your use of Scan365.ai is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the Australian Privacy Act 1988 and the Australian Privacy Principles.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
